I want to sell my house by myself(FSBO). How do I do this? Where do I get the legal paperwork?
I live in South Dakota, if this helps. I want to save money by not paying a realtor fee, since I think I can get a buyer on my own. The problem is, I want to make sure I am doing everything legally.
I am a Realtor and will of course say you are better off with an agent. Buyers will tend to think they are saving money instead of buying one listed, so you may in fact save nothing. Either way, but as a loaw student, do not use a office store contract or any other general contract. State laws govern real estate transactions and South Dakota has its own laws and those pre printed contracts are published to cover the entire country, hence they don’t usually hold up as binding in court. Contact your local or state real estate board, they should be able to provide you with a contract that is specific to local laws. To sell your own home, just put out a sign and advertise it, whenever people are in it check to make sure all doors and windows are locked after they leave and get everyones name that comes in, I’d ask for a drivers license and write down their name, if they don’t want to give it there is a reason, there are certain security risk to letting strangers in your house unfortunately so be prepared, selling your house is in no way worth your families saftey being compromised. Second contact a title company, they could also provide you with a contract and quotes on closing costs, and can pull preliminary title work, this will save time later. You can also contact an attorney or a realtor and ask for quotes just on the paperwork, this should be cheap.
